What is the difference between community property and separate property?

- Community property is anything that a husband and wife own together and/or acquired and earned during the marriage or domestic partnership. This includes debts incurred by either spouse up to the time of separation.


- Separate property is anything that a husband and wife owns separately. This commonly includes anything owned before getting married, anything earned or received after you separate, and anything you may have received as a gift or by inheritance, at any time.
